Turfly Terms of Service

Welcome to Turfly. These Terms of Service ("Terms") form a legally binding agreement between you and Turfly Limited, a private limited company incorporated under the laws of the People's Republic of Bangladesh ("Turfly," "we," "us," or "our").

By downloading, accessing, or using the Turfly mobile application or website (collectively, the "Platform"), you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use of the Platform immediately.

1. What Turfly Does (and What It Does Not Do)

Turfly operates as a digital marketplace and Merchant of Record that allows players to discover, buy, and manage bookings at independently owned sports turfs and facilities ("Hosts").

Turfly does not own, operate, manage, supervise, or control any venue listed on the Platform. All venue services are provided exclusively by Hosts. Your legal agreement for use of a turf or facility exists solely between you and the Host. Turfly's involvement is limited to facilitating bookings, processing payments, and providing technology infrastructure.

Slot availability and booking synchronization depend on real-time connections with the Counterfoil system and other third-party infrastructure. While we strive for accuracy, occasional delays, synchronization failures, or rare double-bookings may occur. Turfly is not responsible for errors caused by third-party system failures but will assist with refunds where applicable under these Terms.

2. Eligibility and Accounts

You must be at least 13 years old to use Turfly. If you are under 18, you may only use the Platform with the consent and supervision of a parent or legal guardian.

When you create an account, you are responsible for:

  • Keeping your login credentials secure
  • All activity conducted through your account
  • Notifying us immediately of unauthorized use

Turfly is not responsible for losses caused by unauthorized access resulting from your failure to protect your credentials.

3. Pricing, Payments, and Bookings

Turfly uses dynamic pricing, meaning slot prices may change based on demand, time of day, availability, and promotions. The price shown at checkout is always the final price. Once payment is completed, prices cannot be adjusted retroactively.

Turfly acts as Merchant of Record for transactions and accepts payments through integrated gateways including Visa, MasterCard, bKash, and Nagad. Unless explicitly stated otherwise, listed prices do not include VAT or AIT, which remain your responsibility where applicable.

If you complete a transaction through the Apple App Store or Google Play Store, all refund requests must be submitted directly to Turfly. Apple and Google do not process booking refunds.

A booking is only considered confirmed once you receive a digital booking confirmation inside the app. Some bookings may be instantly confirmed after payment, while others may require Host approval.

4. Cancellations and Refunds

As a general rule, all bookings are non-refundable. We do not issue refunds for:

  • Change of mind
  • Weather conditions
  • Personal scheduling conflicts
  • No-shows

Refunds are only issued in limited circumstances, including:

  • When a Host cancels a confirmed booking
  • When a verified technical failure prevents a booking from being created
  • When a rare double-booking occurs due to system synchronization failure

In all approved refund cases:

  • Turfly's liability is strictly limited to the booking amount paid
  • We do not cover travel costs, lost time, injuries, or indirect damages

Each Host sets its own cancellation policy, which is shown during checkout. Turfly cannot override Host cancellation rules.

5. User Conduct and Venue Responsibility

You agree to use the Platform lawfully and respectfully. You must not:

  • Attempt to bypass Turfly to avoid platform fees
  • Harass or abuse venue staff, players, or Turfly support
  • Use bots, scrapers, or automated access tools
  • Use the Platform for any unlawful purpose

You are responsible for leaving venues in the condition you found them. Any damage caused by you or your guests may result in financial liability determined by the Host.

6. Assumption of Risk and No Insurance

Sports and physical activities involve inherent and unpredictable risks, including serious injury or death. By booking through Turfly, you knowingly and voluntarily assume all such risks.

Turfly does not provide any form of insurance coverage, including:

  • Health insurance
  • Accident insurance
  • Liability insurance
  • Property damage insurance

Any insurance protection must be obtained independently by you or the venue operator.

7. Platform Disclaimer

The Turfly Platform is provided on an "as is" and "as available" basis. We make no guarantees regarding:

  • Venue safety
  • Host service quality
  • Fitness for a particular purpose
  • Availability or uninterrupted operation

Turfly disclaims all warranties to the maximum extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Turfly shall not be liable for indirect, incidental, special, punitive, or consequential damages
  • Turfly shall not be liable for injuries, property damage, or losses occurring at a venue
  • Turfly shall not be liable for losses caused by Host actions or inactions

Total cumulative liability, if any, shall not exceed the total amount paid by you to Turfly in the six (6) months preceding the claim.

9. Apple & Google App Store Terms

Your agreement is between you and Turfly — not Apple or Google. Apple and Google:

  • Do not provide support, maintenance, or warranties for Turfly
  • Are not responsible for booking disputes or venue services
  • Are third-party beneficiaries of these Terms and may enforce them where applicable

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the People's Republic of Bangladesh. Any dispute arising from your use of Turfly shall fall under the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

11. Updates to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Continued use of the Platform after updates means you accept the revised Terms.
